(hereinafter referred to as \u201cAIM Life\u201d or \u201cAIM Cancer Center\u201d), with NIPC 516817930, and headquartered at Start Esposende, Largo Rodrigues Sampaio, N\u00ba 37, 4740-218 Esposende, establishes these General Terms and Conditions.<\/p>\n<p>These Terms and Conditions apply to the use of the website <a href=\"http:\/\/www.aim.clinic\/\"><strong>aim.clinic<\/strong><\/a> and <strong>to all services provided by AIM Life<\/strong>, including (but not limited to) consultations and clinical acts, <strong>ESLO<\/strong> training (professional training in oncology), corporate programmes under <strong>AIM Corporate Health<\/strong> and <strong>scientific research<\/strong> activities conducted by AIM Life.<\/p>\n<p><em>By using the website or any AIM Life service, the user, patient, trainee or partner entity (hereinafter referred to as the \u201cUser\u201d) declares that they have read, understood and agree to comply with these Terms and Conditions, as well as all applicable laws and regulations. If the User does not agree with any of these conditions, they should refrain from using the site or AIM Life services.<\/em><\/p>\n<h2 class=\"p1\">2. <strong>Acceptance and Changes to the Terms<\/strong><\/h2>\n<p><strong>Acceptance:<\/strong> Access to and use of the <a href=\"http:\/\/www.aim.clinic\/\"><strong>aim.clinic<\/strong><\/a> site or AIM Life services implies acceptance of these Terms and Conditions by the User. This acceptance constitutes a binding agreement between the User and AIM Life.<\/p>\n<p><strong>Changes:<\/strong> AIM Life reserves the right, at any time and without prior notice, to amend, add, update or delete, in part or in whole, these Terms and Conditions. Any changes take immediate effect upon their online publication. AIM Life will make reasonable efforts to notify all users in the event of a substantial change to these Terms and Conditions. However, the User must periodically consult this page to check for updates. If the User does not agree with any modification to the Terms, they must stop using the site and services. Continued use of the services after the publication of changes constitutes acceptance thereof.<\/p>\n<h2 class=\"p1\">3. Services Provided by AIM Life<\/h2>\n<p>AIM Life offers a variety of healthcare services, namely:<\/p>\n<ul>\n<li><strong>Website and Online Portal:<\/strong> Through the <a href=\"http:\/\/www.aim.clinic\/\"><strong>aim.clinic<\/strong><\/a> site, Users can obtain information about AIM Life\u2019s activity and services, <strong>book consultations<\/strong>, <strong>schedule video consultations<\/strong> (teleconsultations) and access information about <strong>professional training and events<\/strong>. Some areas of the site may require user registration and login.<\/li>\n<li><strong>Consultations and Clinical Acts:<\/strong> Specialised clinical services (particularly in oncology and integrative health) provided by qualified healthcare professionals, remote consultations (telemedicine) and any clinical interventions or treatments. These services are provided in accordance with applicable clinical and ethical standards.<\/li>\n<li><strong>ESLO Training:<\/strong> Professional training programmes, continuing education and e-learning in oncology (and other health areas) provided by AIM Life (designated <strong>ESLO<\/strong> \u2013 <em>E<\/em>uropean School of <em>L<\/em>ifestyle <em>O<\/em>ncology). Includes online courses, in-person sessions, congresses, workshops and other training events aimed at healthcare professionals and interested audiences.<\/li>\n<li><strong>AIM Corporate Health Programmes:<\/strong> Occupational health and corporate wellbeing programmes offered to companies, which include services such as health screenings, assessment consultations for employees, health and lifestyle workshops, continuous medical follow-up, among others. Such programmes are contractually tailored between AIM Life and the client company, benefiting its employees.<\/li>\n<li><strong>Scientific Research:<\/strong> Research activities and clinical trials in the field of oncology and health sciences, promoted or co-organised by AIM Life, in which patients or volunteers may participate <strong>voluntarily<\/strong> and subject to appropriate informed consent and Ethics Committee approval.<\/li>\n<\/ul>\n<p>These Terms are intended to comprehensively regulate all the situations described above. However, certain services may be governed by <strong>specific conditions or additional contracts<\/strong> (for example, contracts entered into with companies under corporate programmes, informed consent forms in clinical acts or specific terms of participation in scientific studies). In such cases, these Terms apply subsidiarily and in addition to the specific agreed conditions.<\/p>\n<h2 class=\"p1\">4. Access to the Website and Digital Platform<\/h2>\n<p>Access to the <a href=\"http:\/\/www.aim.clinic\/\"><strong>aim.clinic<\/strong><\/a> website is generally free and not subject to prior registration for basic browsing. However, certain features (such as service booking, access to the client\u2019s reserved area or online course content) may require User registration and authentication via their own credentials.<\/p>\n<p>AIM Life <strong>may suspend or restrict access<\/strong> to the site, in whole or in part, at any time, namely for maintenance, updates or security reasons. AIM Life retains the exclusive right, at any time, to temporarily or permanently shut down the site or any of its features, at its discretion, without prior notice.<\/p>\n<p>The User is responsible for ensuring the technical conditions necessary to access the site and online services (computer equipment, internet connection, up-to-date software, etc.). AIM Life makes efforts to ensure that the site operates continuously and securely, but <strong>does not guarantee<\/strong> the absence of interruptions or operating errors, nor that the site will be available permanently and infallibly.<\/p>\n<p><strong>Use of Cookies and Session Data:<\/strong> The site may use cookies or similar technologies to improve the browsing experience, under the terms of AIM Life\u2019s <a href=\"https:\/\/aim.clinic\/en\/privacy-politics\/\">Privacy Policy<\/a> and <a href=\"https:\/\/aim.clinic\/en\/cookies-policy\/\">Cookies<\/a> Policy.<\/p>\n<h2 class=\"p1\">5. <strong>Rules of Use of the Website<\/strong><\/h2>\n<p>When using the <a href=\"http:\/\/www.aim.clinic\/\"><strong>aim.clinic<\/strong><\/a> site and other AIM Life digital platforms, the User undertakes to:<\/p>\n<ul>\n<li><strong>Proper use:<\/strong> Not use the site for unlawful, fraudulent, false, threatening, abusive, defamatory, obscene or discriminatory purposes or content. In particular, the User must not introduce content that infringes third-party rights, including intellectual property rights, privacy or other personal rights.<\/li>\n<li><strong>System integrity:<\/strong> Refrain from inserting or spreading computer viruses, <em>worms<\/em>, <em>malware<\/em>, <em>Trojan horses<\/em> or any other malicious codes or programmes that may damage or interfere with the normal functioning of the site or AIM Life\u2019s systems. Any attempted attack or misuse of the system will result in suspension of access and the offender being held liable.<\/li>\n<li><strong>Truthfulness of data:<\/strong> Provide true, up-to-date and complete information in registration forms, service bookings or other forms made available on the site. The User must not falsely impersonate another person or use third-party personal data without authorisation.<\/li>\n<li><strong>Respect for AIM Life and third parties:<\/strong> Not perform any acts that may damage the image, reputation or rights of AIM Life, its employees, partners or other Users. This includes refraining from any use of the site that intentionally overloads the infrastructure or interferes with other Users\u2019 access.<\/li>\n<\/ul>\n<p>In the event of a violation of these rules, AIM Life reserves the right to <strong>suspend or block access<\/strong> by the infringing User to the site and services, as well as to take appropriate legal measures.<\/p>\n<h2 class=\"p1\">6. <strong>Scheduling, Cancellations and Refund Policy<\/strong><\/h2>\n<p>This section sets out the booking and cancellation conditions applicable to the different services provided by AIM Life:<\/p>\n<p>&nbsp;<\/p>\n<h3><strong>6.1 Consultations and Clinical Services<\/strong><\/h3>\n<ul>\n<li>All medical consultations <strong>must be booked in advance<\/strong> via the website, telephone contact or other channels made available for this purpose. After the booking request, AIM Life will confirm to the User the date, time and other details of the consultation.<\/li>\n<li>AIM Life <strong>pre-confirms<\/strong> each scheduled consultation and may request additional information or relevant clinical documentation from the User prior to the consultation.<\/li>\n<li><strong>Cancellations by the User:<\/strong> Consultation cancellations are accepted at no cost up to <strong>24 hours before<\/strong> the scheduled date\/time. The cancellation must be communicated through the means provided (cancellation option in the portal, telephone contact or email).<\/li>\n<li>Cancellations communicated with <strong>less than 24 hours\u2019<\/strong> notice, as well as failure by the User to attend the consultation without prior notice, entitle AIM Life to <strong>charge the full amount<\/strong> of the missed consultation, unless the User demonstrates just cause for non-attendance (for example, a proven medical emergency).<\/li>\n<li><strong>Cancellations by AIM Life:<\/strong> If AIM Life (or the healthcare professional) needs to cancel or postpone a consultation (for example, due to force majeure, doctor\u2019s unavailability, technical problems in a teleconsultation, etc.), the User will be informed as soon as possible. In such cases, <strong>rescheduling<\/strong> to a new convenient date\/time will be offered; if this is not possible or the User so prefers, a <strong>full refund<\/strong> of any amounts already paid for that cancelled consultation will be issued.<\/li>\n<li><strong>Delays and waiting time:<\/strong> AIM Life makes efforts to keep to scheduled times. For remote consultations, the User should connect at the appointed time, with a reasonable delay being tolerated from both parties. If technical problems prevent the teleconsultation from taking place, the parties will agree on a new attempt or rescheduling at no additional cost.<\/li>\n<li><strong>Payment:<\/strong> Unless otherwise agreed, consultations must be paid by the User or the responsible entity in accordance with the current price list. AIM Life may require prepayment at the time of booking or ensure payment via arrangement\/insurer where applicable. The payment data provided will be processed in accordance with the Privacy Policy.<\/li>\n<\/ul>\n<h3><strong>6.2 Professional Training (ESLO)<\/strong><\/h3>\n<ul>\n<li>Participation in courses, e-learning modules or other training activities of AIM Life requires <strong>prior enrolment<\/strong> and, where applicable, payment of the respective tuition fees or enrolment fees as per the conditions announced for each training.<\/li>\n<li><strong>Enrolment Confirmation:<\/strong> After enrolment, AIM Life will confirm to the trainee their acceptance on the course. If there is a candidate selection process and the trainee is <strong>not selected<\/strong>, <strong>100% of the amount paid<\/strong> by them will be refunded.<\/li>\n<li><strong>Cancellation by the trainee\/client (withdrawal):<\/strong> The trainee (or the entity funding the training) may cancel enrolment without penalty <strong>within 14 days<\/strong> of entering into the training contract (enrolment), by unequivocally communicating their decision in writing (letter or email), indicating their full name and the course in question. In such case, AIM Life will refund <strong>100% of the amount paid<\/strong> for the course, provided that the trainee has not started attending the training or accessed the online content during that 14-day period.<\/li>\n<li>During the period between enrolment and the end of the cost-free cancellation period (14 days), the trainee should not access the training sessions or content (if already made available) if they intend to exercise the cancellation. If they do so and subsequently request cancellation within the 14 days, they <strong>will lose the right to a refund<\/strong> of the amounts paid, since they have already used the training service.<\/li>\n<li><strong>Late cancellations:<\/strong> After the 14-day period has elapsed or outside the conditions above, no refunds will be given in the event of withdrawal at the trainee\u2019s initiative. If the trainee decides to withdraw or suspend the training <strong>after the indicated deadlines<\/strong>, they are responsible for full payment of the amounts due until the end of the current contractual period. There will be no refund of amounts paid and, if there are instalments falling due until the end of the training or until the effective date of withdrawal, these must be settled by the trainee or client entity.<\/li>\n<li><strong>Cancellation by AIM Life:<\/strong> AIM Life reserves the right to cancel or bring forward a training activity if a minimum number of participants is not met or for organisational reasons (for example, trainer unavailability, logistical issues). In such cases, registrants will be informed and <strong>100% of the amounts paid<\/strong> will be refunded, unless they choose to keep the credit for a new date or an equivalent training. AIM Life does not assume responsibility for other costs incurred by the trainee (such as transport and accommodation) in the event of training cancellation, while committing to give notice as far in advance as possible.<\/li>\n<li><strong>Attendance and access:<\/strong> The trainee undertakes not to share their access credentials to the e-learning platform or course materials with third parties. Access to digital content is personal and non-transferable, and unauthorised reproduction or distribution is prohibited (see also <strong>Intellectual Property Rights<\/strong> below).<\/li>\n<li><strong>Absence or abandonment:<\/strong> Failure by the trainee to attend training sessions (in person or at a distance) or abandonment of the training activity without any prior communication does not entitle them to a refund of amounts paid.<\/li>\n<\/ul>\n<h3><strong>6.3 Congresses, Events and Workshops<\/strong><\/h3>\n<ul>\n<li>For in-person events (such as congresses, conferences, workshops) organised by AIM Life, enrolment is normally mandatory and may be paid in advance. Given logistical planning, <strong>cancellations with a right to refund are not accepted for in-person events<\/strong> once enrolment has been completed, except if the event is cancelled by the organiser.<\/li>\n<li>If, due to force majeure, the User is unable to attend an in-person event for which they have registered, they should contact AIM Life as soon as possible. Replacement by another participant indicated by the User or other ad-hoc solutions may be considered at AIM Life\u2019s discretion, but there is no obligation to refund in this case.<\/li>\n<li>If an event <strong>is cancelled or postponed by AIM Life<\/strong> (for organisational reasons, speaker unavailability, etc.), registrants will be informed and will be entitled to a full refund of the registration fees paid, unless they agree to transfer the registration to a new event date.<\/li>\n<\/ul>\n<h3><strong>6.4 AIM Corporate Health Programmes (Corporate)<\/strong><\/h3>\n<ul>\n<li>In partnerships with companies for corporate health programmes, the conditions for booking and cancelling services will be set out in the specific contract with the client company.<\/li>\n<li>In general, the client company should centralise booking requests or provide employees with access to scheduling platforms as agreed. Cancellations or rescheduling by beneficiary employees should be communicated with a reasonable minimum notice of 24 (twenty-four) hours through the designated channels, and in principle the same <strong>no-show<\/strong> policies defined for individual consultations will apply (the company may bear the cost of consultations not cancelled in time).<\/li>\n<li>AIM Life undertakes to make efforts to accommodate rescheduling requested by the company or employees, within operational limits.<\/li>\n<li>If an employee benefiting from a corporate programme fails to attend a scheduled consultation or examination without prior notice within the due period, AIM Life will inform the client company for internal management purposes (for example, possible charging to the company for unjustified absences, as per contract). Specific health data of the employee <strong>will not be shared with the company<\/strong> without the employee\u2019s consent, respecting clinical confidentiality (see <strong>Data Protection<\/strong> section).<\/li>\n<li><strong>Programme Cancellation:<\/strong> If the company wishes to cancel or suspend an ongoing corporate programme, it should check the applicable contractual conditions (there will normally be notice periods and settlement of services already provided). Likewise, AIM Life reserves the right to terminate a corporate contract early due to breach by the other party or for justified reasons, upon written notice with adequate advance, as provided for in the contract.<\/li>\n<\/ul>\n<h2 class=\"p1\">7. <strong>Informed Consent and Clinical Procedures<\/strong><\/h2>\n<p>AIM Life operates in accordance with the legal and ethical principles relating to <strong>informed consent<\/strong> in the provision of healthcare. In particular:<\/p>\n<ul>\n<li><strong>Requirement of consent:<\/strong> No medical act or clinical treatment will be carried out without the patient\u2019s <strong>free and informed consent<\/strong> (or that of their legal representative in the case of incapacity or a minor), except in the exceptional situations provided for by law (for example, life-threatening emergencies in which the patient cannot express consent). AIM Life healthcare professionals have a duty to provide the patient with adequate, clear and understandable information about the diagnosis, treatment options, risks and benefits involved, so that the patient can make an informed decision.<\/li>\n<li><strong>Form of consent:<\/strong> Informed consent may be obtained in writing whenever required, through specific forms that detail the procedure and collect the patient\u2019s signature. In routine consultations or low-risk acts, consent may be verbal, but must still be preceded by the necessary explanation. AIM Life keeps a record of informed consents given, in compliance with legal standards.<\/li>\n<li><strong>Telemedicine:<\/strong> In the case of <strong>remote consultations (teleconsultations)<\/strong> or telemonitoring, by agreeing to have the consultation remotely, the User is also consenting to this model of healthcare provision. AIM Life ensures that teleconsultations comply with the guidelines of the Portuguese Medical Association and other authorities for telemedicine. The User will be informed about the limitations inherent to a non-presential consultation (for example, impossibility of a complete physical examination) and must follow the healthcare professional\u2019s instructions during the call. At any time, if the doctor considers an in-person examination or referral necessary, they will explain this to the patient and may recommend a physical consultation.<\/li>\n<li><strong>Right to refuse or seek a second opinion:<\/strong> The patient\/User has the right to refuse a proposed treatment or procedure, as well as to seek a second medical opinion. AIM Life will endeavour to clarify any questions the patient may have, but will respect their choices and preferences in line with the user\u2019s right to self-determination.<\/li>\n<li><strong>Minors and incapable persons:<\/strong> In the case of minors or patients unable to express their will, authorisation will be requested from their legal representatives under the law. AIM Life strictly observes the legal rules relating to consent in paediatric age and the protection of incapacitated adults.<\/li>\n<li><strong><strong>Physical exercise\/Pilates: <\/strong><\/strong>Within the scope of physical exercise, Pilates, functional rehabilitation or other physical activity programmes, including when carried out remotely, the User acknowledges that remote supervision entails inherent limitations when compared to in-person observation, namely with regard to the assessment of movement execution, posture, the physical condition of the location where the session is held, and other circumstances liable to influence the practice of the activity.\n<p class=\"font-claude-response-body break-words whitespace-normal\">The User is responsible for ensuring that they have an adequate and safe space for carrying out remote sessions, free from obstacles or other factors liable to compromise their safety.<\/p>\n<p class=\"font-claude-response-body break-words whitespace-normal\">The User is responsible for ensuring that they are in adequate physical and health condition for the practice of the proposed activity.<\/p>\n<p class=\"font-claude-response-body break-words whitespace-normal\">The User undertakes to inform the professional in advance, and in any event before the start of each session, of any contraindication, pain, discomfort, functional limitation, worsening of symptoms or change in their state of health liable to influence their participation, and must further report immediately any symptom or discomfort that arises during the session. The User is responsible for the accuracy, completeness and updating of the information they provide.<\/p>\n<p class=\"font-claude-response-body break-words whitespace-normal\">Without prejudice to the User&#8217;s duty to provide information, whenever, in accordance with their technical and professional judgement and the available information, the professional considers that conditions exist which may compromise the safety of the practice, the professional may adapt, interrupt, suspend or refuse to carry out the session, as well as recommend a medical assessment or in-person observation.<\/p>\n<p class=\"font-claude-response-body break-words whitespace-normal\">AIM is liable solely for damages resulting from facts legally attributable to it, including cases of proven professional negligence, in accordance with the applicable legislation and civil liability coverage. Excluded from the scope of AIM&#8217;s liability are events arising from pre-existing health conditions, from failure to comply with the guidance provided by the professionals, from improper use of equipment, from the unsuitability of the space, or from the risks normally associated with the practice of exercise.<\/p>\n<\/li>\n<\/ul>\n<h2 class=\"p1\">8. <strong>Participation in Scientific Research<\/strong><\/h2>\n<p>As part of its mission, AIM Life may engage in research projects, clinical studies or scientific trials. The participation of users\/patients in these activities is governed by the following principles:<\/p>\n<ul>\n<li><strong>Voluntariness:<\/strong> Participation in any scientific study or research project <strong>is entirely voluntary<\/strong>. No user is obliged or automatically included in research without their explicit consent. Refusal to participate does not in any way affect the quality of clinical care provided by AIM Life outside the study.<\/li>\n<li><strong>Specific Informed Consent:<\/strong> In addition to general consent for healthcare, a <strong>study-specific Informed Consent Form<\/strong> will be presented to the prospective participant, explaining in accessible language the research objectives, procedures involved, potential benefits, risks and discomforts, as well as the participant\u2019s rights. Only after all questions have been clarified and signed consent obtained will the participant be formally included in the study.<\/li>\n<li><strong>Ethical Approval:<\/strong> All studies involving human beings promoted by AIM Life will be conducted within the strict limits of the law. AIM Life complies with national and international ethical guidelines of good clinical practice in research.<\/li>\n<li><strong>Confidentiality of Research Data:<\/strong> Personal and clinical data collected for research purposes will be treated with strict confidentiality and in accordance with the GDPR and other applicable legislation. Wherever possible, data will be <strong>anonymised or pseudonymised<\/strong> to protect participants\u2019 privacy. Study results may be published in scientific journals or conferences, but under no circumstances will participants\u2019 identities be revealed, unless expressly consented otherwise.<\/li>\n<li><strong>No cost to participants:<\/strong> Unless otherwise stated in the informed consent, participation in studies will not entail additional costs for the participant, nor will they normally be entitled to financial compensation (except for possible reimbursement of expenses such as travel, when provided). If there is any incentive or compensation, this will be clarified in advance in the consent process.<\/li>\n<li><strong>Right to withdraw:<\/strong> The participant may <strong>withdraw from the research at any time<\/strong>, even after having given consent, simply by expressing this wish. Such withdrawal does not require justification and will not prejudice the participant in terms of their regular clinical follow-up. AIM Life will ensure that there is no negative impact on the therapeutic relationship or continuity of care for those who choose not to participate or to withdraw from a study.<\/li>\n<\/ul>\n<h2 class=\"p1\">9. <strong>Personal Data Protection and Privacy (GDPR)<\/strong><\/h2>\n<p>AIM Life attaches great importance to the protection of Users\u2019 personal data, particularly as it deals with <strong>health data<\/strong>, considered special-category sensitive data under Article 9 of the General Data Protection Regulation (GDPR). In this matter, the following principles apply:<\/p>\n<ul>\n<li><strong>Controller:<\/strong> AIM Life, LDA. is the entity responsible for processing the personal data provided by Users in the context of the services provided. All AIM Life information and contacts for privacy matters are available in the Privacy Policy on the <a href=\"http:\/\/www.aim.clinic\/\">website<\/a>.<\/li>\n<li><strong>Purposes of Collection:<\/strong> The personal data collected serve <strong>legitimate and explicit purposes<\/strong>, such as: scheduling and provision of healthcare, maintenance of the patient\u2019s clinical record, billing and collection of services, enrolment and attendance on training activities, management of participation in corporate programmes or scientific studies, communication with the User for bookings or sending results, and compliance with legal obligations.<\/li>\n<li><strong>Health Data:<\/strong> Any information relating to a person\u2019s physical or mental health, past, present or future \u2013 including diagnoses, treatments, clinical history, test results \u2013 is processed with the highest degree of confidentiality, in accordance with the duty of medical professional secrecy and GDPR standards. This data <strong>will only be used<\/strong> for purposes directly related to the provision of healthcare to the data subject (or research purposes, if they have consented), and <strong>will never<\/strong> be communicated to third parties without the data subject\u2019s consent, except where required by law or order of a competent authority.<\/li>\n<li><strong>Legal Basis for Processing:<\/strong> Most data processing by AIM Life is based on the necessity for the performance of a contract (for example, provision of the consultation service requested by the patient) or on compliance with legal obligations in the health domain. Where applicable, the data subject\u2019s consent will be obtained \u2013 for example, for marketing purposes (sending newsletters) or for participation in scientific research. The User has the right to withdraw optional consents at any time, without prejudice to processing already carried out.<\/li>\n<li><strong>Retention:<\/strong> Personal data will be retained only for the strictly necessary period. Clinical data may have legal retention periods. Training or client data will be kept for as long as the contractual relationship and subsequent obligations (billing, guarantees, etc.) last, or in accordance with consent in force for optional purposes.<\/li>\n<li><strong>Data Subjects\u2019 Rights:<\/strong> AIM Life is committed to fulfilling the rights of data subjects whose data it processes, under the GDPR. For more information about the rights you have over your data, please consult AIM Life\u2019s Privacy Policy on AIM\u2019s website. Note that, due to the nature of healthcare services, some requests (such as deletion of clinical data) may not be fully feasible due to legal retention obligations or public interest in health (the User will be informed in such cases).<\/li>\n<li><strong>Security Measures:<\/strong> AIM Life implements appropriate technical and organisational measures to protect personal data against destruction, loss, alteration, disclosure or unauthorised access. This includes secure storage of clinical data in IT systems with access control, encryption of sensitive information wherever possible, secure protocols (HTTPS) on the website, confidentiality ensured by all staff and continuous training in data protection. In the event of a security breach that seriously compromises personal data, AIM Life undertakes to report the incident to the competent authorities (CNPD) and to the data subjects, as required by the GDPR.<\/li>\n<li><strong>Privacy Policy:<\/strong> More detailed information on the processing of personal data by AIM Life is described in the <strong>Privacy Policy<\/strong> and Cookies Policy available on the website. Reading of this supplementary document is recommended. In all matters not described in these Terms, the provisions of AIM Life\u2019s Privacy Policy apply, which is deemed an integral part of these Terms by reference.<\/li>\n<\/ul>\n<h2 class=\"p1\">10. <strong>Intellectual Property Rights<\/strong><\/h2>\n<p>All content made available by AIM Life \u2013 whether on the website, in training materials, scientific publications or any media \u2013 is protected by intellectual property rights (copyright, related rights, registered trademark, design, etc.) and is owned by AIM Life, LDA. or by third parties who have licensed its use to AIM Life.<\/p>\n<p>&nbsp;<\/p>\n<p>In particular:<\/p>\n<ul>\n<li>The design of the <a href=\"https:\/\/aim.clinic\"><strong>aim.clinic<\/strong><\/a> site, texts, images, graphics, logos, icons, audio\/video clips, software and database, as well as the selection and organisation of such content, are the property of AIM Life (or partner entities) and are protected by applicable copyright and industrial property laws.<\/li>\n<li><strong>Didactic and scientific materials:<\/strong> ESLO courses and training provide trainees with materials that, unless otherwise indicated, are produced by AIM Life and its trainers. Such materials are made available <strong>exclusively for the personal and educational use<\/strong> of registrants, with no ownership or licence for commercial exploitation being transferred. The User is prohibited from copying, reproducing, distributing, publishing or making such content available to third parties without AIM Life\u2019s prior written authorisation. Recording of classes or sessions is also not permitted without consent.<\/li>\n<li>The User is <strong>not authorised<\/strong> to modify, rent, lend, sell, assign or create derivative works from any content obtained from AIM Life without authorisation. Mere use of the services or access to the materials does not confer any rights on the User over them, other than the right of use under the agreed terms.<\/li>\n<li><strong>Trademarks and distinctive signs:<\/strong> \u201cAIM Life\u201d, \u201cAIM Cancer Center\u201d, the respective logo and other trade marks or trade names displayed on the site or in communications are the property of AIM Life (or third parties, where indicated). Nothing in these Terms may be interpreted as granting the User permission to use any AIM Life marks, logos or names, except as necessary to identify AIM Life\u2019s services during their legitimate use. Any improper or unauthorised use of marks or content may result in civil and\/or criminal liability.<\/li>\n<li><strong>User contributions:<\/strong> If the User submits content to the AIM Life site or platforms (comments, feedback, suggestions, testimonials or others), they warrant that such content does not infringe third-party rights and is not unlawful. The User grants AIM Life a non-exclusive, royalty-free, worldwide, transferable licence to use, reproduce or adapt such content within AIM Life\u2019s activities. Although we strive to keep the information accurate, up-to-date and complete, this content <strong>does not constitute personalised medical advice<\/strong> nor does it in itself establish any doctor-patient relationship. For concrete medical advice appropriate to the individual situation, the User should always consult directly a qualified healthcare professional. AIM Life assumes no responsibility for actions taken based on generic site information without professional consultation.<\/li>\n<li><strong>Efforts and quality of services:<\/strong> AIM Life ensures that clinical services will be provided by duly qualified professionals registered with the competent professional orders (Ordem dos M\u00e9dicos, Ordem dos Enfermeiros or others, as applicable), in compliance with current legal and ethical obligations. However, AIM Life <strong>does not guarantee specific results<\/strong> in medical or therapeutic acts \u2013 for example, it does not guarantee the cure of a disease or absolute success of a given treatment \u2013 but guarantees that care is provided diligently and in accordance with best practices. In the provision of educational services, AIM Life undertakes to provide quality content, but does not guarantee that the trainee will achieve certain outcomes or certifications merely by attending the training.<\/li>\n<li><strong>Limitation of liability for damages:<\/strong> To the fullest extent permitted by law, AIM Life shall not be liable for indirect, incidental, special or consequential damages suffered by the User or third parties as a result of the use of its services or the site. This includes, for example, loss of data, loss of profits, loss of business opportunities or reputation, which do not result directly from AIM Life\u2019s gross negligence or wilful misconduct.<\/li>\n<li><strong>Medical liability:<\/strong> Civil liability for any errors or omissions in the provision of healthcare will be assessed under the applicable Portuguese law. AIM Life and its professionals have professional civil liability insurance as required by the <strong>Statute of the Portuguese Medical Association<\/strong> and related legislation. However, without prejudice to patients\u2019 legal rights, any compensation due for AIM Life\u2019s liability will not exceed the limits legally established and\/or the maximum amounts covered by compulsory insurance.<\/li>\n<li><strong>Specific exclusions:<\/strong> AIM Life cannot be held liable for: (a) <strong>technical failures<\/strong> of the site or teleconsultation platforms that temporarily prevent the use of services (although we make efforts to promptly resolve any failures); (b) <strong>acts or omissions of the User<\/strong>, including incorrect or incomplete clinical information provided by the patient, or failure to comply with medical recommendations; (c) damages resulting from <strong>force majeure<\/strong> or events beyond AIM Life\u2019s control, such as natural disasters, telecommunications interruptions, sophisticated cyberattacks despite security measures, etc.<\/li>\n<li><strong>Products and third parties:<\/strong> If, in the context of training or clinical recommendations, AIM Life indicates products, medicines, devices or third-party services, such indication is purely informative. AIM Life assumes no responsibility for third-party products purchased by the User, nor for the content of third-party websites to which it may provide <em>links<\/em> (see the section on Links to Third Parties below). The User should follow the manufacturer\u2019s or supplier\u2019s instructions for the products, with any defects or damages arising from the use of such products falling outside AIM Life\u2019s scope.<\/li>\n<li><strong>Maximum liability amount:<\/strong> Without prejudice to mandatory legal provisions to the contrary, AIM Life\u2019s overall liability towards the User for facts arising from the performance or use of the services covered by these Terms shall have as its maximum limit the amount actually paid by the User for the service that is the origin of the compensation claim. This clause applies to contractual and non-contractual liabilities, to the extent permitted by law, and does not affect inalienable consumer rights.<\/li>\n<\/ul>\n<p>Nothing in these Terms is intended to exclude or limit AIM Life\u2019s liability in cases of wilful misconduct or other situations where the law prohibits such limitation. In short, AIM Life will be liable under the general terms of law, but will benefit from all permitted liability limitations, as outlined above and in applicable special legislation.<\/p>\n<h2 class=\"p1\">12. <strong>Links to Third-Party Websites<\/strong><\/h2>\n<p>The <a href=\"http:\/\/www.aim.clinic\/\"><strong>aim.clinic<\/strong><\/a> site may include <strong>hyperlinks (links)<\/strong> to external sites belonging to other entities. These links are provided solely for the User\u2019s convenience or information. AIM Life <strong>has no control<\/strong> over the content of such third-party sites, does not operate them nor necessarily endorses the information, products or services described therein.<\/p>\n<p>Accordingly, AIM Life <strong>assumes no responsibility<\/strong> for the content, policies, practices or performance of third-party sites accessible via links on its site. Use of such links is the User\u2019s sole responsibility and at their own risk. It is recommended that the User read the terms of use and privacy policies of any other sites they visit through links provided on <a href=\"http:\/\/www.aim.clinic\/\">aim.clinic<\/a>.<\/p>\n<p>AIM Life reserves the right to request the removal of unauthorised links to its site, created by third parties, which may, in its view, harm its image or activity.<\/p>\n<h2 class=\"p1\">13. <strong>Suspension and Termination of Services<\/strong><\/h2>\n<p>AIM Life may temporarily suspend the provision of a specific service, or terminate the contractual relationship with the User, in the following circumstances, upon appropriate notice where possible:<\/p>\n<ul>\n<li><strong>Breach of the Terms:<\/strong> If the User seriously or repeatedly violates these Terms and Conditions (for example, abusive use of the platform, persistent non-payment of due services, improper disclosure of confidential or proprietary materials), AIM Life may suspend the User\u2019s access to the services or even terminate the contract, where applicable, for just cause. Prior to termination, AIM Life will make efforts to notify the User and allow them to correct the breach (\u201cwarning letter\u201d), unless the seriousness of the breach justifies immediate termination.<\/li>\n<li><strong>Security or Legal Reasons:<\/strong> Immediate suspension of a service (for example, interruption of access to ESLO Courses) may occur if security vulnerabilities, unauthorised accesses are detected, or if there is an order from a competent authority to do so. In such cases, AIM Life will seek to restore the service as soon as security is ensured or the legal order is complied with.<\/li>\n<li><strong>Discontinuation of services:<\/strong> AIM Life reserves the right, for business management reasons, to discontinue the provision of certain services or to close certain units\/activities. If, for example, it decides to terminate a recurring training programme or to stop offering teleconsultations in a specialty, and if the User has ongoing contracts involving those services, AIM Life will inform them with the maximum reasonable advance notice, proposing alternative solutions (such as transfer to another equivalent programme, or refund of amounts paid for future services not provided).<\/li>\n<\/ul>\n<p><strong>Effects of termination:<\/strong> In the event of termination of the contractual relationship, the User\u2019s rights to use the corresponding services cease. The User remains obliged to pay any amounts due for services already enjoyed. The clauses of these Terms which, by their nature, should continue to produce effects after termination (confidentiality obligations, liability limitations, dispute resolution agreement, among others) will remain in force.<\/p>\n<h2 class=\"p1\">14. <strong>General Provisions<\/strong><\/h2>\n<h3>14.1 Partial Invalidity<\/h3>\n<p>If any provision of these Terms and Conditions is found to be invalid, illegal or unenforceable by a competent entity (such as a court), such invalidity <strong>shall not affect the validity of the remaining provisions<\/strong>. The affected clause shall be applied to the maximum extent permitted, reflecting the original intention of the parties, and the remaining conditions shall remain fully in force.<\/p>\n<h3>14.2 Communications<\/h3>\n<p>For contractual and legal purposes, the User agrees that AIM Life\u2019s communications will preferably be carried out by electronic means (to the email provided, via notifications in their reserved area of the site or other digital channels). Whenever these Terms or the law require \u201cin writing\u201d, this requirement is deemed satisfied by electronic communication. Other means may, however, be used where appropriate. The User must keep their contact details provided to AIM Life up to date.<\/p>\n<h3>14.3 Applicable Law<\/h3>\n<p>The formation, validity, performance and interpretation of these Terms and Conditions, as well as all relationships arising therefrom, are governed by <strong>Portuguese Law<\/strong>, in particular by the legislation applicable to healthcare service contracts and consumer law in force.<\/p>\n<h3>14.4 <strong>Alternative Dispute Resolution<\/strong><\/h3>\n<p>In the event of a dispute arising from the provision of AIM Life\u2019s services or the interpretation of these Terms, the parties undertake to <strong>make efforts to reach an amicable resolution<\/strong>. The User may submit any complaint through AIM Life\u2019s contacts or via the following <a href=\"https:\/\/aim.clinic\/en\/contacts\/\">form<\/a>. AIM Life will seek to respond to and resolve the complaint internally within a reasonable timeframe.<\/p>\n<p>If a satisfactory solution is not achieved, the User (if they are legally qualified as a consumer in the context of the dispute) may resort to <strong>Consumer Alternative Dispute Resolution (ADR)<\/strong> mechanisms, such as mediation, conciliation or arbitration, under the law.<\/p>\n<p>AIM Life will inform the User, at their request or whenever legally required, about the ADR entity(ies) available and competent to consider the dispute, indicating the name, contact and website thereof.<\/p>\n<p>In any case, the possibility of recourse to the judicial courts remains, but the parties acknowledge that prior mediation can lead to a quicker and less burdensome resolution.<\/p>\n<p>For issues arising from the provision of healthcare, the User also has the right to submit a complaint to the <strong>Health Regulatory Authority (ERS)<\/strong> or to the corresponding professional order. These mechanisms do not exclude the judicial route, but may be used in a complementary manner.<\/p>\n<h3>14.5 Competent Jurisdiction<\/h3>\n<p>In the absence of resolution by amicable means or through ADR, it is stipulated that <strong>the court of the Braga District<\/strong>, Portugal, shall have jurisdiction to settle any disputes arising from the validity, interpretation or performance of these Terms and Conditions, with express waiver of any other jurisdiction. This choice of jurisdiction does not prejudice the application of mandatory territorial competence rules arising from consumer protection law, should the User have that status and choose to bring proceedings in another legally admissible district.<\/p>\n<h3>14.6 <strong>Last Update<\/strong><\/h3>\n<p>These Terms and Conditions were reviewed and last updated on <strong>14 August 2025<\/strong> (fully replacing previous versions). The version in force is always available on AIM Life\u2019s website.
